Real Estate
Development
Since our Firm is concerned at all times with covering
the laws that govern the entire real estate chain, real estate development
plays a key role. It forms the link between constructions initiated by
government authorities (urban development) and acquisitions by individuals,
institutions or investors in already standing buildings.
In our Firm, real estate development is composed of two phases in which
we are equally involved:
Phase I: Acquisition of the land
We advise the developer not only at the time of drafting of the deed of
sale, but also as regards pre-contract negotiations and the monitoring
of fulfillment of conditions precedent. During this stage, we work as
a team, since the lawyer in charge of the transaction has the task of
mobilizing and bringing together the Firm's other capabilities that may
turn out to be required in terms of:
  Public
law
  Local
government laws
  Urban
law and the securing of administrative authorizations
  The
laws governing cooperative properties and volumes
  Tax
law
Phase II:
This concerns the sale of a property already built or in the process of
being built.
If the property is sold as a whole, the project is assigned to the person
in charge of the transaction.
If it is sold on a per-unit basis to individual buyers, the deeds are
then assigned to lawyers specializing in the sale "of the program".
In this connection, a specific ISO 9001 standard describes in great detail
the obligations of the Firm, which concern the computerized maintenance
of the register, the reception of the clientele, the observance of deadlines,
as well as the disclosure and the reports we must provide to the developer.
